Home / Is it legal to start a business out of my apartment?
01/07/2022
Currently, with the rapid development of business types, the use of apartments as business locations is not uncommon. Are all apartments used for business locations?
According to Clause 3, Article 3 of the Law on Housing, an apartment building is defined as follows:
3. An apartment building is a house with 2 floors or more, with many apartments, with common walkways and stairs, with a private part, a part under common ownership, and a system of infrastructure works for common use by households, individuals and organizations, including apartment buildings built for residential purposes and condominiums built with mixed-use purposes for residential and business purposes.

Accordingly, apartments have two types of use purposes: the living building and mixed-use building (for residential and business). Therefore, not all apartments are only used for living without a business license:
- The apartment is built for living: The design and architecture of the apartment building are only used for living, not for business purposes.
- The apartment is built for mixed use: This apartment can be used for living or for other purposes such as offices, companies, businesses...
Therefore, it is completely possible to use the apartment building as a business location, but it must be used for the approved purpose when the investor is allowed to build the apartment. People are still allowed to use the apartment to do business, but it must be the type of apartment built for mixed use.
