Divorce with foreign elements, especially applying for a unilateral divorce, will have plenty difficulties and problems in legal matters. The reason is that at present this issue has not been synchronized in the legal system and for different objective reasons. In the following article, Thinh Tri Law will share some legal aspects of divorce with foreign elements.

1. What is called a divorce with foreign elements?
Divorce involving foreign elements includes: divorce between Vietnamese citizens and foreigners, and between foreigners permanently residing in Vietnam.
2. Jurisdiction to settle divorce cases involving foreign elements?
- According to the law, the jurisdiction to settle divorce with water element belongs to the People's Court of the province. Specifically:
- If one party is a Vietnamese citizen at the time of the divorce request but does not permanently reside in Vietnam, it shall be settled according to the law of the country where the couple permanently resides.
- If the husband and wife do not have a permanent place of residence, the settlement shall be in accordance with Vietnamese law, dispute settlement of property being immovable property upon divorce will be handled in accordance with the laws of the country where such immovable property is located.
- Documents in the dossier of consent for divorce have foreign elements
- Application for consent to divorce (according to the form of each place);
- The original marriage registration certificate;
- Copy of household registration book, ID card/Chip- based citizen card/Passport of 2 involved parties;
- A copy of the child's birth certificate (if there are children in common);
- Other documents and evidences evidencing common property or separate property if there is a dispute over property.
- Documents in the unilateral divorce file with foreign elements
- The petition (according to the form of each place);
- Original Marriage Certificate (if any);
- ID card/Chip- based citizen card/Passport, household registration book (certified copy) (if the other party's identity papers are not available, prepare papers of the divorcee);
- A copy of the child's birth certificate (if there are children in common);
- Authenticated copies of vouchers and documents on ownership of common and separate properties if there is a property dispute;
- Documents proving that one party is abroad (if any).
4. Order and procedures for divorce settlement involving foreign elements

Step 1: File for divorce at a competent court
- The involved parties shall submit valid dossiers of application for divorce at the competent People's Courts (based on the competence mentioned in Section 1).
- Step 2: The court examines the file and accepts the request for divorce
- Within 7-15 days, the Court will check the file, if the file is complete and valid, the Court will send a notice of advance payment. The involved parties shall pay the first-instance civil fee advance at the District/City Judgment Enforcement Sub-department, then go to the Court to pay the advance fee receipt.
- Step 3: Open the mediation hearing
- The court opened a mediation session. If the mediation is successful, the Court will make a record of successful conciliation. Within 07 days, if the parties do not change their opinions, the Court will issue a decision to recognize the successful conciliation. If conciliation fails, the Court will proceed with the divorce according to first-instance procedures.
- Step 4: The court issues a divorce judgment
- If it deems that there are sufficient conditions to settle the divorce, the Court will issue a judgment to terminate the marriage relationship of the couple or to recognize the consent of the divorce and settle divorce-related issues, if requested by the parties.
- Normally, the time to settle a divorce case involving foreign elements is 4-6 months from the date of acceptance, the first-instance court fee in a divorce case is 300,000 VND if there is no dispute over property, if If there is a dispute over property, the court fee is determined according to the value of the property.

Đang làm việc ở nước ngoài nhưng muốn ly hôn thì phải làm sao.
- Trong trường hợp bên là công dân Việt Nam không thường trú ở Việt Nam vào thời điểm yêu cầu ly hôn thì việc ly hôn được giải quyết theo pháp luật của nước nơi thường trú chung của vợ chồng; nếu họ không có nơi thường trú chung thì giải quyết theo pháp luật Việt Nam.In case the party being a Vietnamese citizen does not permanently reside in Vietnam at the time of request for divorce, the divorce shall be settled according to the law of the country where the husband and wife reside together; if they do not have a common place of permanent residence, the settlement shall be in accordance with Vietnamese law.
- Như vậy, thủ tục ly hôn đối với người đang làm việc tại nước ngoài có thể tiến hành giải quyết tại Tòa án nhân dân tỉnh, thành phố trực thuộc trung ương nơi thường trú của công dân Việt Nam đang làm việc ở nước ngoài. Nếu vợ chồng đồng thuận ly hôn, Vợ/chồng đang ở Việt Nam có thể tiến hành nộp tại Tòa án nhân dân cấp tỉnh. Trong trường hợp là đơn phương xin ly hôn, mà người xin ly hôn đang ở nước ngoài thì bạn làm đơn khởi kiện và nộp hồ sơ nộp hồ sơ bằng cách sau:Thus, divorce procedures for people working abroad can be resolved at the People's Courts of the provinces and centrally-run cities where the Vietnamese citizens are working abroad permanently. - Trong trường hợp bên là công dân Việt Nam không thường trú ở Việt Nam vào thời điểm yêu cầu ly hôn thì việc ly hôn được giải quyết theo pháp luật của nước nơi thường trú chung của vợ chồng; nếu họ không có nơi thường trú chung thì giải quyết theo pháp luật Việt Nam.
- Như vậy, cả hai vợ chồng là người Việt Nam nhưng hiện tại cả hai đang cư trú tại nước ngoài, vậy nên đối với trường hợp này vợ chồng phải nộp đơn xin ly hôn tại Tòa án ở nước mà hai vợ chồng đang cư trú để tiến hành các thủ tục ly hôn.In case the party being a Vietnamese citizen does not permanently reside in Vietnam at the time of request for divorce, the divorce shall be settled according to the law of the country where the husband and wife reside together; if they do not have a common place of permanent residence, the settlement shall be in accordance with Vietnamese law.
