- Re-register birth certification documents
- Clause 1, Article 26 of Decree No. 123/2015 / ND-CP stipulates that a birth registration dossier comprises the following documents:
- Declaration form as prescribed by law.
- Copies of all documents, papers of the requester or records, papers, other documents including information related to the content of the person's birth certificate.
Cadres, civil servants, officers and persons working in the armed forces must have written certification of the heads of agencies or units that the birth registration contents include such as last name, middle name, first name; sex; date of birth; ethnic group; nationality; home town; The parents -child relationship consistent with the records managed by the agency or unit.
- Papers and documents are the basis of birth re-registration as prescribed in Article 9 of the Circular No. 04/2020 / TT-BTP dated May 28, 2020
- Papers and documents the basis of birth re-registration as prescribed at point b, clause 1, Article 36 of the Decree no.123/2015/NĐ-CP
- A valid copy of the birth certificate issued by a competent Vietnamese agency.
- Originals or copies of papers with surrogatevalid value for the birth certificate issued before 1945 in the North and before 1975 in the South of Vietnam.
- In case the requester for birth registration does not have the papers specified in Clauses 1 and 2 of this Article, the following valid papers issued by a competent Vietnamese agency or organization shall be the basis for determination the birth re-registration content:
- Identity Card, Citizen Identification Card or Passport.
- Household registration book, temporary residence book, papers proving residence.
- Diplomas, Certificates, Certificates, Transcripts, and academic records issued or certified by the competent authority.
- Other papers containing information about the individual's full name, date, month and year of birth.
- The applicant for re-registration of birth registration is responsible for submitting a full copy of the above papers (if any) and assuring that he / she has submitted all of the documents he has; take responsibility and the consequences of making a guarantee that is not true according to Article 5 of this Circular.
- In case documents of the requester for birth registration do not contain information to prove the parents- child relationship, the civil status registration agency shall request in writing the competent police agency to verify.
- In case the police station replies that there is no information, the civil status registration agency shall give the applicant for re-registration to make a written guarantee of the parent's information as prescribed in Articles 4 and 5 This information and determine the content of birth registration according to the written guarantee.
- Time for Birth re-registration
- Within 05 working days since the receiving date of documents, judicial officers or civil status officials verify the dossiers. If the birth re-registration is lawful, the civil status officer and judicial officer will execute the re-issuance.
- If the birth registration is re-registered at the People's Committee of the commune level that is not the place where the first birth registration was previously registered, the judicial officer - civil status officer shall report to the President of the People's Committeea written request the People's Committee of the place of first birth registration to checks and verifies the keeping of civil status books in the locality.
- Within 05 working days since the receiving date of proposal document, the People's Committee issued lost birth registration will inspect, verify and reply in written document about whether or not to keep a civil status book.
- Within 03 working days since the receiving date of confirmation that the civil status book is not kept at the place of birth registration. If the record is complete, accurate and lawful, civil servants - civil status re-register the birth certificates for citizens.
- Fee for birth re-registration
- In Ho Chi Minh City: Fee at the Commue People's Committee is 50,000 VND per case and 50,000 VND per case at the district level as the Resolution 124/2016 / NQ-HDND issued by Ho Chi Minh city People's Council.
